Terms of Service

By downloading, installing, accessing or using the SociosPlus mobile app or website (the "Service"), you accept these Terms of Service. If you do not agree, do not use the Service.

1. Service description

SociosPlus is a multi-tenant SaaS platform for trade unions, mutual aid societies, professional associations and clubs ("Organizations") to manage member rosters, dues, benefits, medical leave, declarations and procedures.

The mobile app is a wrapper (Trusted Web Activity/WebView) that displays the mobile view of the Organization's web portal. The only user profile in the app is "Member".

2. Roles: data controller and processor

Key point: the ultimate controller of member data (roster, dues, benefits, medical leave, etc.) is the Organization. SAMUEL GASTON BERENSTEIN acts as Processor on behalf of the Organization, following its documented instructions.

SAMUEL GASTON BERENSTEIN acts as Controller only for platform operational data (logs, sign-in accounts, security incidents) and for information visitors provide directly through the corporate site (sociosplus.la). See the Privacy Policy for details.

3. Requirements to use the app

  • Be at least 16 years old.
  • Be a member of an Organization that uses SociosPlus.
  • Have valid credentials issued or enabled by your Organization.
  • Have a compatible mobile device with Internet connection.
  • Accept these Terms and the Privacy Policy.

4. Permitted and prohibited use

You agree to:

  • Use the Service for lawful purposes and per these Terms.
  • Keep your credentials confidential; you are responsible for all activity on your account.
  • Upload accurate, up-to-date information that does not infringe third-party rights.

It is expressly prohibited to:

  • Perform scraping, crawling or automated bulk collection.
  • Reverse engineer, decompile or disassemble the Service.
  • Share credentials or allow third-party use of your account.
  • Upload unlawful, defamatory or infringing content, malware or spyware.
  • Interfere with normal operation or try to breach security measures.
  • Use the Service for unauthorized advertising, spam or bulk solicitation.

5. Intellectual property

The "SociosPlus" brand, logo, site and app design, source code and documentation are owned by SAMUEL GASTON BERENSTEIN or its licensors. Any unauthorized use is prohibited.

Content you upload (photos, documents, certificates, etc.) remains your property. By uploading it you grant the Organization and SociosPlus a limited, non-exclusive and revocable license to store, process and display it through the Service for the sole purpose of providing it to you, per the Privacy Policy.

6. Service availability

The Service is provided to the end member on a best-effort basis, with no guaranteed SLA. It may be suspended for maintenance, updates or force majeure. Any SLAs are agreed in the B2B contract between SAMUEL GASTON BERENSTEIN and each Organization and are not enforceable by the end member against SociosPlus.

7. Limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by the law applicable to your country of residence, SAMUEL GASTON BERENSTEIN is not liable for:

  • Indirect, incidental, special or consequential damages.
  • Loss of profit or moral damage, except in cases of willful misconduct or gross negligence.
  • The accuracy of data uploaded by the Organization or other users.
  • Connectivity, device or operating system failures.

Nothing in this clause limits liabilities that cannot be excluded under consumer protection laws applicable to you.

8. Changes to the Terms

We may modify these Terms. Material changes will be announced with at least 30 days' advance notice via publication at this URL and notification to your registered email and/or in-app. Continued use after the effective date implies acceptance.

9. Governing law

  • With the end member: governed by the laws of the member's country of residence; consumer protection statutes prevail.
  • With the Organization (B2B): as agreed in the commercial contract signed with SAMUEL GASTON BERENSTEIN.

10. Dispute resolution

The parties agree to attempt a good-faith prior mediation for at least 30 days after formal notice of the claim.

If no agreement is reached, the competent jurisdiction shall be:

  • For consumer members: the courts of the consumer's domicile, where required by their country's consumer protection law (typical in Argentina, Chile, Colombia, Mexico and Uruguay).
  • For the Organization: as agreed in the B2B contract.

11. Account deletion

You may request the deletion and anonymization of your account at any time via:

  1. The app: Profile → Settings → Delete my account.
  2. The website: https://sociosplus.la/en/eliminar-cuenta/.

Maximum processing time: 30 days from verification. Only data legally required to be retained is kept (e.g. payment history for tax periods).
